RELIGIOUS FREEDOM: Protect the Right to Opt Out

Disagree

Catholic & other religious businesses may opt-out of providing services in violation of their faith. Catholic/Christian beliefs do not disqualify judicial nominees.

Description: LOS ANGELES -- Attorney General Kamala D. Harris issued the following statement on the U.S. Supreme Court ruling in Burwell v. Hobby Lobby: 'A woman’s access to quality, affordable preventive healthcare coverage should not depend on her employer’s beliefs. Every woman should be able to make healthcare decisions for herself and her family. I am deeply disappointed that the Court ruled to limit this important right. The decision also opens a perilous loophole that may enable private, for-profit companies to challenge other common-sense laws—including those that protect against discrimination—based on the religious beliefs of their shareholders or managers.' In January 2014, Attorney General Harris was joined by 13 states and the District of Columbia to file a friend-of-the-court brief that urged the U.S. Supreme Court to overturn the decision by the U.S. Court of Appeals for the Tenth Circuit which held that for-profit businesses may exercise religion and therefore are covered by the Religious Freedom Restoration Act of 1993."

Description: "We can't let this go unnoticed: last week the White House rolled out a plan to allow health care providers to cite their religious or moral beliefs to *deny* treatments to patients. This is absurd and flies in the face of putting patients first."

Description: "Here’s the truth: the First Amendment Defense Act does not enhance religious freedom. It is an attempt to undermine marriage equality." (First Amendment Defense Act prohibits the federal government from discriminatory action against a person on the basis that such person believes or acts in accordance with a religious belief or moral conviction that: (1) marriage is or should be recognized as the union of one man and one woman, or (2) sexual relations are properly reserved to such a marriage.)

Description: Scrutinizing Judicial Nominees’ Knights of Columbus Memberships As a senator, Harris pressed three judicial nominees about their affiliations with the Knights of Columbus: Brian Buescher, Paul Matey and Peter Phipps. Her questions suggested that the nominees’ ties to the Catholic fraternal organization could make them biased because the group adheres to Church teachings about life and marriage. In written questions to Buescher, for example, Harris asked the nominee whether he knew “that the Knights of Columbus opposed a woman’s right to choose when [he] joined the organization.” She questioned whether he agreed with then-Supreme Knight Carl Anderson that abortion is “the killing of the innocent on a massive scale.” She asked him whether he knew “that the Knights of Columbus opposed marriage equality when [he] joined the organization.” Buescher, responding to Harris, informed her that “the Knights of Columbus is a Roman Catholic service organization with approximately 2 million members worldwide.” “The organization has a religious and charitable purpose,” he continued. “I joined the Knights of Columbus when I was 18 years old and have been a member ever since. My membership has involved participation in charitable and community events in local Catholic parishes.”

Description: "Regulating the Speech of Pro-Life Pregnancy Centers As California’s attorney general, Harris co-sponsored and promoted the Reproductive FACT Act, which required pro-life pregnancy centers to post notices that provided information on where to obtain abortions. Pro-life pregnancy centers sued the attorney general’s office, arguing that the law violated their First Amendment rights. In 2018, the U.S. Supreme Court ruled that the law violated the right to free speech because it compelled speech. The legislation served as a model for lawmakers in other states, such as Vermont and Illinois, who tried to regulate the speech of pro-life pregnancy centers. "

Description: Democratic vice presidential nominee Sen. Kamala Harris (D-Calif.), who was previously attorney general of California, has a record of legislative and judicial advocacy for laws protecting abortion or targeting pro-life pregnancy centers, many of which are operated by Catholics. California's Reproductive FACT Act, passed in 2015, required medically licensed pro-life pregnancy centers to post signs advertising the availability of free or low-cost abortion procedures in the state. The law was struck down by the Supreme Court in 2018.

Description: "You reported that you have been a member of the Knights of Columbus since 1993. The Knights of Columbus has taken a number of extreme positions. For example, it was reportedly one of the top contributors to California’s Proposition 8 campaign to ban same-sex marriage. a. If confirmed, do you intend to end your membership with this organization to avoid any appearance of bias? The Knights of Columbus is a Roman Catholic service organization with approximately two million members world-wide. I have not drafted any policies or positions for the national organization. If confirmed, I will abide by the Code of Conduct of United States Judges and will not affiliate with any organization in violation of the Code. b. If confirmed, will you recuse yourself from all cases in which the Knightsof Columbus has taken a position? The Knights of Columbus does not have the authority to take personal political positions on behalf of all of its approximately two million members. If confirmed, I will apply all provisions of the Code of Conduct for United States Judges, including Canon 3(C), regarding recusal and disqualification. 8. In May of this year, the Knight of Columbus issued a statement in support of the Trump administration’s efforts to bar clinics that provide abortion services or referrals from receiving federal family-planning funds under Title X funds. In 2016, the Knights of Columbus online magazine published an article claiming that contraceptives have “potentially dangerous side effects related to women’s health” and that “[a] growing bodyof research indicates that contraception even alters a woman’s ability to choose a more genetically suited spouse” because “contraception suppresses fertility and its corresponding hormones.” a. You were a member of the Knights of Columbus when they published these statements. Reproductive health providers who receive Title X funds provide a critical service to women. Do you believe federal funds should not be given to these providers who support abortion services? As a nominee to a Federal Court, I believe it would be inappropriate to enter into a public discussion regarding political issues such as Title X funds. In addition, questions of such funds are or likely will be the subject of additional federal litigation. I believe it would be inappropriate to opine on issues that may come in front of the Court at some point. "
